Deported Mexican Immigrants Reenter the United States.

A group of six immigrants who had been deported after signing a voluntary departure have been given parole to cross the Mexican/California border, to have their day in Court. This has been possible as a result of an agreement that permitted these six non-citizens to cross the border but which does not change their status.

The news that was broadcast on the Univision Network has created great excitement among the Hispanic community, as this is the first case to occur. It could represent a solution to their migratory status. On this occasion this first group of 6 individuals was permitted to come over the border but there are thousands more Mexican immigrants affected by the controversial “Lopez Venegas v. Johnson” Class action.

Each one of these cases will require the assistance of an immigration attorney, specialized and bilingual, to represent them on their day in court.   Their legal status has not altered, but this allows those deported or removed from the United States, to request a legal immigration status in compliance with due process and the immigration judge will decide .

The procedure is formally known as “administrative voluntary departure,” but is often referred to as voluntary return, and has been used to expel hundreds of thousands of non-citizens from Southern California in recent years.  Among the requirements to qualify under this class action, a non-citizen must have signed a document of voluntary departure between June 1, 2009 and on 28 August 2014, and have been deported to Mexico.

The exact number of non-citizens affected by this ruling and waiting at the border with California is expected to be over 1,500, of which so far only 6 have been permitted to return under these strict conditions. Depending on the decision taken by the judge at the immigration court, the number could continue to increase.
